These Terms and Conditions ("Terms") govern the relationship between Studio Luminea ("the Studio", "we", "us", or "our") and any individual or organisation ("the Client", "you", or "your") who books, purchases, or otherwise engages our photography services, products, or gift vouchers. By making a booking or purchase with Studio Luminea, you confirm that you have read, understood, and agreed to these Terms in full.
1. Definitions
- Session refers to any photography appointment, shoot, or event covered by Studio Luminea, including but not limited to portrait sessions, family sessions, wedding photography, and event photography.
- Package refers to a bundle of services and/or products as described in our current price list or custom quotation.
- Digital Gallery refers to the online portal through which edited digital images are delivered to the Client.
- Final Images refers to the edited and retouched photographs selected for delivery as part of the agreed Package.
- Booking Deposit refers to the non-refundable payment required to secure a Session date.
- Gift Voucher refers to a prepaid credit issued by Studio Luminea, redeemable against eligible services.
2. Booking & Confirmation
2.1 A Session is considered confirmed only upon receipt of a signed booking agreement (where applicable) and payment of the required Booking Deposit.
2.2 The Booking Deposit is non-refundable and is applied toward the total cost of the Session. The amount of the Booking Deposit will be stated at the time of booking.
2.3 The remaining balance of the session fee is due in full no later than 48 hours prior to the Session date, unless otherwise agreed in writing.
2.4 Studio Luminea reserves the right to release a reserved date if the Booking Deposit is not received within 5 calendar days of the booking being made.
2.5 By confirming a booking, the Client warrants that they are authorised to do so on behalf of all individuals who will participate in the Session.
3. Payments
3.1 Studio Luminea accepts payment by bank transfer or such other methods as may be stated on our website or invoice at the time of booking.
3.2 All prices are stated in the applicable local currency and include any applicable taxes unless expressly stated otherwise.
3.3 Payment of any invoice not received by the due date may result in the withholding of images, prints, or other deliverables until the outstanding balance is settled in full.
3.4 In the event of a dispute regarding charges, the Client must notify Studio Luminea in writing within 14 days of the invoice date. Disputes raised after this period may not be considered.
3.5 Studio Luminea reserves the right to amend its pricing at any time. Price changes will not affect bookings already confirmed with a paid Booking Deposit.
4. Cancellations
4.1 Cancellation by the Client. If the Client cancels a confirmed booking:
- More than 28 days before the Session: the Booking Deposit is forfeited; no further charges apply.
- Between 14 and 28 days before the Session: the Booking Deposit is forfeited; a cancellation fee of up to 50% of the remaining balance may apply.
- Fewer than 14 days before the Session: the Booking Deposit is forfeited; the full session fee becomes payable.
4.2 All cancellations must be submitted in writing to hello@studioluminea.net and are effective from the date received by Studio Luminea.
4.3 Cancellation by Studio Luminea. In the unlikely event that Studio Luminea must cancel a booking due to unforeseen circumstances (including illness, equipment failure, or force majeure), all monies paid by the Client will be refunded in full. Studio Luminea's liability is limited to this refund and no further compensation shall be payable.
5. Rescheduling
5.1 Requests to reschedule a Session must be submitted in writing at least 7 days before the original Session date.
5.2 One complimentary reschedule is permitted per booking, subject to availability. Any subsequent reschedule request will incur an administrative fee of 20% of the total session fee.
5.3 If the Client fails to attend the Session without prior notice ("no-show"), the full session fee will be forfeited and no reschedule will be offered without a new Booking Deposit.
5.4 Studio Luminea will make reasonable efforts to accommodate rescheduling requests but cannot guarantee the same date, time, or studio setup.
5.5 In exceptional circumstances (e.g. serious illness supported by a medical certificate), rescheduling outside the standard notice period may be considered at the sole discretion of Studio Luminea.
6. Delivery of Images & Products
6.1 Editing & Selection. Studio Luminea will select and professionally edit the Final Images at its own discretion. The number of Final Images delivered will be as specified in the agreed Package. Unedited, raw, or rejected images will not be provided under any circumstances.
6.2 Delivery Timeframe. Final Images will be delivered via the Digital Gallery within the timeframe stated in the Package description - typically 2–4 weeks from the Session date, or as otherwise confirmed in writing. During peak periods, delivery may take longer; the Client will be notified where applicable.
6.3 Physical Products. Where a Package includes printed products (albums, prints, canvases, etc.), production and delivery times will be advised separately. Studio Luminea is not liable for delays caused by third-party print suppliers.
6.4 Image Retention. Digital files will be available for download from the Digital Gallery for a period of 30 days from delivery. After this period, Studio Luminea cannot guarantee the retention of files. The Client is solely responsible for backing up all delivered images.
6.5 Style & Creative Direction. Studio Luminea's editing style is reflected in our portfolio. Specific style requests should be discussed prior to the Session. We do not alter our core editing style to match another photographer's work.
6.6 Faulty Products. If a physical product arrives damaged or faulty, the Client must notify Studio Luminea in writing within 7 days of receipt, with supporting photographs. Studio Luminea will arrange a replacement at no additional charge.
7. Intellectual Property & Image Use
7.1 Studio Luminea retains full copyright ownership of all images created during the Session. The copyright remains with the photographer at all times.
7.2 The Client is granted a personal, non-exclusive, non-transferable licence to use the Final Images for personal, non-commercial purposes (including social media sharing, personal printing, and display in the home).
7.3 The Client may not sell, sublicense, alter, or use the images for commercial purposes without the prior written consent of Studio Luminea.
7.4 Studio Luminea reserves the right to use any images taken during the Session for portfolio display, website use, social media, exhibitions, and marketing materials, unless the Client has submitted a written opt-out request prior to the Session. Opt-out requests will be honoured and do not affect the quality or delivery of services.
7.5 When sharing Studio Luminea images on social media, the Client is encouraged (though not obliged) to credit @luminealuminea or tag studioluminea.net.
8. Client Conduct
8.1 The Client is responsible for ensuring that all session participants behave in a respectful and cooperative manner throughout the Session.
8.2 Studio Luminea reserves the right to refuse or terminate a Session without refund if any participant behaves in an abusive, threatening, or disruptive manner toward Studio Luminea staff.
8.3 Children participating in a Session must be accompanied by a parent or legal guardian at all times. The accompanying adult is responsible for the safety and supervision of minors.
8.4 The Client is responsible for any damage caused to Studio Luminea's premises, equipment, or props by themselves or any session participant. The cost of repair or replacement will be charged to the Client.
8.5 Clients are asked to arrive on time for their scheduled Session. If the Client arrives more than 15 minutes late, Studio Luminea may need to shorten the Session accordingly, with no reduction in the agreed fee.
9. Liability
9.1 Studio Luminea will exercise all reasonable professional care and skill in the provision of photography services.
9.2 In the event of equipment failure, loss of data, or other unforeseen technical circumstances beyond Studio Luminea's reasonable control, our liability shall be limited to a refund of monies paid for the affected session. No further compensation shall be payable.
9.3 Studio Luminea holds appropriate professional liability insurance. Details are available upon request.
9.4 Studio Luminea is not liable for any indirect, consequential, or special losses arising from a failure to deliver services as agreed, including loss of enjoyment or third-party costs (e.g. venue, styling, or travel).
9.5 Nothing in these Terms limits or excludes liability for death, personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
10. Force Majeure
10.1 Studio Luminea shall not be in breach of these Terms, nor liable for any failure or delay in performance, where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disaster, epidemic or pandemic, fire, flood, severe weather, civil unrest, government action or restriction, or failure of essential utilities or infrastructure.
10.2 In such circumstances, Studio Luminea will contact the Client as soon as reasonably practicable and will work in good faith to reschedule the Session at the earliest available opportunity.
10.3 Where rescheduling is not possible within a reasonable timeframe as a direct result of a force majeure event, Studio Luminea may offer a full or partial refund at its discretion, having regard to any costs already incurred.
11. Gift Vouchers
11.1 Issuance. Gift Vouchers are issued by Studio Luminea and may be purchased online or in person. Each Gift Voucher will state its face value or the specific service it covers.
11.2 Validity Period. Gift Vouchers are valid for 6 months from the date of issue/purchase. The expiry date is communicated at the time of issue. Gift Vouchers must be redeemed and the corresponding Session must be booked within this 6-month period. No extensions will be granted under any circumstances.
11.3 Redemption. To redeem a Gift Voucher, the Client must present the unique voucher code at the time of booking. Gift Vouchers are redeemable against eligible Studio Luminea services only and cannot be used to purchase further Gift Vouchers.
11.4 Non-Refundable. Gift Vouchers are non-refundable and cannot be exchanged for cash, in whole or in part.
11.5 Non-Transferable for Commercial Gain. Gift Vouchers may be gifted to a third party but may not be resold or transferred for commercial gain.
11.6 Partial Redemption. Where the value of the Gift Voucher exceeds the cost of the service booked, the remaining balance is not refundable and will be forfeited. Where the cost of the service exceeds the Gift Voucher value, the Client must pay the difference.
11.7 Expiry. Expired Gift Vouchers will not be reactivated or extended under any circumstances. Studio Luminea accepts no responsibility for vouchers not used within the validity period.
11.8 Lost or Stolen Vouchers. Studio Luminea is not responsible for Gift Vouchers that are lost, stolen, or used without the recipient's authorisation. Clients should treat their Gift Voucher code with the same care as a financial instrument.
12. Privacy & Data Protection
12.1 Studio Luminea collects and processes personal data in accordance with applicable data protection legislation and our Privacy Policy, available at studioluminea.net.
12.2 Client data is used solely for the purpose of administering bookings, delivering services, and - where consent has been given - for marketing communications. We do not sell or share personal data with third parties except where necessary to fulfil your order (e.g. print labs).
12.3 The Client may request access to, correction of, or deletion of their personal data at any time by contacting hello@studioluminea.net.
13. Complaints & Disputes
13.1 Studio Luminea is committed to delivering an exceptional client experience. If you are dissatisfied with any aspect of our service, please contact us in writing at hello@studioluminea.net within 14 days of the relevant Session or product delivery.
13.2 We will acknowledge your complaint within 5 working days and endeavour to resolve the matter within 28 days.
13.3 These Terms shall be governed by and construed in accordance with applicable law. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the relevant courts.
14. Amendments to These Terms
14.1 Studio Luminea reserves the right to amend these Terms at any time. The current version will always be published at studioluminea.net.
14.2 Bookings confirmed prior to any amendment will be governed by the Terms in effect at the time of booking.
15. Acceptance
By making a booking, purchasing a Gift Voucher, or engaging the services of Studio Luminea, the Client confirms they have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
